Child support is calculated under California law. OC CSS attorneys and Commissioners are required to set guideline child support orders. There are two main factors that will be used to determine the child support amount such as: income of each parent and time/percent of time the child spends with each parent.

Important information:

Each parent will need to have proof (documentation) and/or testimony of their parenting time.

The Commissioner will use the actual number of hours per year the child(ren) spend with parent, not necessarily the amount on the visitation order.

The total monthly income of the parents is usually calculated from pay stubs, W-2 forms or tax returns. On occasion, other source information including statements from employers, Federal Case Registry (FCR) income reporting, or by testimony.

This calculator provides only an estimate and is not a guarantee of the amount of child support that will be ordered. There are many other reasons that may affect the amount of child support awarded. In a IV-D setting the Court Commissioner has the final authority to determine the amount of a child support order.
